Trademark or Copyright but not a Patent
A patent, Apple might be able to fight. But a trademark or a copyright which is what will be the issue here, will be MUCH harder to fight.

i think this is useless issue to try to damage iphone 5 popularity.
why every one is talking about iphone 5 and ios 6 defects why not talk about its new awesome features also???
